Commercial Litigation

Commercial Litigation encompasses a wide range of business disputes including breach of contract, tortious interference with contract, partnership and LLC member liability, misrepresentation and violation of fiduciary duties.

Hoffman, et al. v. Sumner, et al.
In a high-stakes commercial litigation case, Frank Morrissey successfully defended a business owner in a lawsuit over control of three companies with reported annual revenues of over $90 million. In federal court, Morrissey represented the business owner who was sued by two businessmen who claimed to own 2/3 of the three companies.  After extensive litigation, Judge Elaine Bucklo rejected defendants' claim to have a Buy-Sell agreement and granted summary judgment to the business owner.

Date of Decision: March, 2008. Civil Judgment: Complaint seeking control of 2/3 of three companies with reported revenues in excess of $90 million dismissed on Motion for Summary Judgment in favor of plaintiffs. See 2008 WL 162760 (N.D. Ill.)
